1. ABOUT THESE TERMS
These Terms & Conditions govern your use of services provided by Victoria Kain trading as Strength & Simplicity ("we," "us," "our").
By purchasing or using our services, you agree to be bound by these terms.

2. STRENGTH & SIMPLICITY APP / MONTHLY MEMBERSHIP
2.1 Free Trial
START STRONG includes a 14-day free trial period. No payment required during the trial period. You can cancel anytime during the trial without charge. If you do not cancel before the trial ends, you will automatically be enrolled in monthly membership at £19.99/month.
2.2 Monthly Membership
Monthly membership is billed at £19.99 per month. Billing occurs on the same date each month from your initial purchase. Membership continues until you cancel. You can cancel your membership at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to programmes until the end of your paid period.
2.3 No Refunds
All payments are non-refundable. This includes monthly subscription fees and any promotional offers. Cancelling your membership does not entitle you to a refund for the current billing period. If you experience technical issues preventing access to the service, please contact us and we will work to resolve the issue.
2.4 Access to Programmes
You receive access to START STRONG and Strength & Simplicity programmes as part of your membership. Programmes are delivered via the Everfit app platform. You are responsible for maintaining your own app login credentials. Access is for personal use only and may not be shared.
2.5 Content and Intellectual Property
All training programmes, videos, guides, and materials are our intellectual property. You may not copy, distribute, share, or reproduce any content. Content is for your personal use only.
3. 1:1 IN-PERSON PERSONAL TRAINING
3.1 Booking and Payment
Sessions are available on a pay-as-you-go basis. Payment is required at the time of booking. Sessions must be booked in advance. Pricing is confirmed at the time of enquiry.
3.2 Cancellation and Rescheduling
24 hours notice is required for all cancellations or rescheduling requests. Notice must be given via phone, text or email.
Late cancellations (less than 24 hours notice) will be charged at the full session rate. No-shows (failure to attend without notice) will be charged at the full session rate.
Rescheduling is subject to availability. Emergency cancellations will be considered on a case-by-case basis. Extended illness or injury will be considered on a case-by-case basis at the trainer's discretion.
3.3 App Access for 1:1 Clients
App access may be included as part of your coaching arrangement. Details will be confirmed at the time of booking. Access is for personal use only and may not be shared.
3.4 What's Included
1:1 sessions include:

Progress tracking and assessments

App access (where included in your arrangement)
3.5 Location
Sessions take place at the private gym studio near Bishop's Stortford College. Exact address provided upon booking. Free parking available. All sessions are in-studio only — no home visits.
4. HEALTH, SAFETY & LIABILITY
4.1 Health Disclosure
You must disclose any medical conditions, injuries, illnesses, or physical limitations before beginning training. You must inform us immediately if your health status changes. We reserve the right to request medical clearance from your GP before training. Training programmes will be adapted to your individual needs and capabilities.
4.2 Assumption of Risk
You acknowledge that physical exercise carries inherent risks. You participate in all training at your own risk. We are not liable for any injury, illness, or adverse effects resulting from training. You are responsible for listening to your body and exercising within your capabilities.
4.3 Insurance
Victoria Kain holds professional personal training insurance and public liability insurance. Insurance details available upon request.
4.4 Emergencies
In the event of injury or medical emergency during a session, emergency services will be contacted. You consent to necessary emergency medical treatment.
5. PRIVACY & DATA PROTECTION
5.1 Information We Collect
We collect and store: contact information (name, email, phone number), health and fitness information (medical history, injuries, goals), payment information (processed securely via Stripe), and progress data (measurements, weights, photos if provided).
5.2 How We Use Your Information
To provide training and nutrition services, to communicate with you about your programmes, to track your progress and results, and to process payments.
5.3 Data Protection
We comply with UK GDPR and Data Protection Act 2018. Your personal information is kept confidential and secure. We will never sell or share your information with third parties without consent. You have the right to request access to your data or request deletion.
5.4 Testimonials and Marketing
We will only use your testimonials, progress photos, or results with your explicit written consent. You can withdraw consent at any time. Anonymous testimonials may be used without identifying information.
6. GENERAL TERMS
6.1 Changes to Services
We reserve the right to modify, suspend, or discontinue services with reasonable notice. Price changes will be communicated at least 30 days in advance. Existing clients will be given reasonable notice of any changes to their arrangements.
6.2 Changes to Terms
These Terms & Conditions may be updated from time to time. Updated terms will be posted on this page with a new Last Updated date. Continued use of services after changes constitutes acceptance of new terms. Significant changes will be communicated via email.
6.3 Termination
We reserve the right to terminate services if you breach these Terms & Conditions, provide false information, engage in abusive or inappropriate behaviour, or fail to pay for services.
6.4 Disputes
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. We encourage contacting us directly to resolve any issues before pursuing formal action.
6.5 Severability
If any part of these terms is found to be unenforceable, the remaining provisions remain in effect.
6.6 Entire Agreement
These Terms & Conditions constitute the entire agreement between you and Strength & Simplicity. No verbal agreements or promises supersede these written terms.
7. YOUR RIGHTS
7.1 Consumer Rights (UK)
Under UK consumer law: services must be provided with reasonable care and skill, services must match their description, and digital content must be of satisfactory quality.
7.2 Complaints
If you are unhappy with our services, contact us directly to discuss your concerns. We will work to resolve the issue promptly and fairly. If unresolved, you may contact Citizens Advice or Trading Standards.
